TERMS OF SERVICE

Welcome to Perfume Wear. These Terms of Service (“Terms”) govern your use of PerfumeWear.com (the “Site”) and purchases made through the Site.

Throughout these Terms, “Perfume Wear,” “we,” “us,” and “our” refer to Perfume Wear, the operator of PerfumeWear.com. “You” and “your” refer to any visitor, customer, or user of the Site.

By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. ABOUT PERFUME WEAR

Perfume Wear is an independent retail business based in Houston, Texas. We retail fragrances, beauty products, personal-care products, gifts, and other merchandise.

Unless expressly stated otherwise on a particular product page, Perfume Wear is not the manufacturer, trademark owner, or brand owner of third-party branded products offered on the Site.

References to third-party brand names, trademarks, product names, packaging, and images are used solely for product identification and descriptive purposes.

2. ELIGIBILITY AND USE OF THE SITE

You may use the Site only for lawful purposes and in accordance with these Terms.

You agree not to:

  • use the Site for fraudulent or unlawful activity;

  • submit false or misleading information;

  • place orders using payment information you are not authorized to use;

  • interfere with the security or operation of the Site;

  • introduce malicious software or code;

  • scrape, copy, reproduce, or commercially exploit Site content without authorization;

  • infringe the intellectual-property or privacy rights of another person; or

  • attempt to circumvent fraud-prevention, checkout, security, purchasing, or account restrictions.

We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated or fraudulent activity has occurred.

3. CUSTOMER ACCOUNTS

You may be permitted to create a customer account.

You are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.

You agree to provide accurate and current information and to notify us if you become aware of unauthorized access to your account.

We may suspend or terminate an account for fraud, abuse, unlawful activity, violation of these Terms, security concerns, or other legitimate business reasons.

4. PRODUCT INFORMATION

Perfume Wear and PerfumeWear.com make reasonable efforts to ensure that products delivered to customers correspond to the descriptions provided on the Site.

Product descriptions, specifications, images, ingredients, fragrance notes, sizes, packaging information, and other product information are provided in good faith based on information available from applicable brands, manufacturers, distributors, suppliers, and other legitimate commercial sources.

We strive to keep product information accurate and current. However, manufacturers may occasionally change packaging, labels, bottle designs, ingredients, formulations, or other product details without prior notice.

Computer screens and mobile devices may display colors differently. Product images are intended to provide a reasonable representation of the product but may not reproduce every physical detail exactly.

If you believe the product you received materially differs from the product ordered, please contact us promptly.

5. THIRD-PARTY BRANDS AND TRADEMARKS

All third-party trademarks, logos, trade names, product names, bottle designs, packaging, and other intellectual-property rights belong to their respective owners.

The sale or display of a third-party branded product does not, by itself, imply sponsorship, endorsement, partnership, dealership, distributorship, representation, or affiliation between Perfume Wear and the applicable brand.

Perfume Wear does not claim ownership of third-party trademarks displayed for identification of genuine products offered for resale.

Any statement regarding an authorized relationship with a particular manufacturer, distributor, or brand applies only when such a relationship is expressly stated and can be substantiated.

6. PRODUCT AUTHENTICITY

Perfume Wear is committed to selling products represented by us as genuine merchandise.

We source merchandise through established wholesale, distribution, supplier, and other legitimate commercial channels.

Perfume Wear is an independent retailer. The sale or display of a particular brand does not mean that Perfume Wear is an authorized dealer, distributor, representative, affiliate, or partner of that brand unless such a relationship is expressly stated and can be substantiated.

7. ORDERS

An order submitted through the Site is an offer to purchase the products listed in the order.

Receiving an order confirmation does not necessarily mean that we have accepted the order. We may verify payment, inventory availability, shipping information, pricing, fraud indicators, and other relevant information before accepting and fulfilling an order.

We reserve the right to cancel or refuse an order for legitimate reasons, including:

  • product unavailability;

  • pricing or listing errors;

  • suspected fraud or unauthorized payment;

  • incorrect customer or shipping information;

  • quantity limitations;

  • inability to complete delivery;

  • legal or regulatory restrictions; or

  • violation of these Terms.

If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

8. PRODUCT AVAILABILITY

Inventory information is updated regularly, but availability cannot always be guaranteed.

An item may become unavailable after an order is submitted due to simultaneous purchases, inventory discrepancies, damage, supplier changes, or other circumstances.

If we cannot fulfill an order, we may cancel the affected item or order and issue the appropriate refund.

9. PRICING

Prices displayed on the Site are shown in U.S. dollars unless otherwise indicated.

Applicable sales tax, shipping charges, and other charges, if any, are calculated or disclosed during checkout as required.

We make reasonable efforts to ensure pricing is accurate. However, typographical, technical, or listing errors may occur.

If a product is listed at an obviously incorrect price, we may cancel the affected order and refund any amount already paid.

We will not increase the price of an already accepted order without your consent.

10. PAYMENT

You represent that you are authorized to use the payment method submitted with your order.

Payment transactions may be processed by third-party payment providers and may be subject to their additional terms and privacy practices.

We may use fraud-prevention and verification systems to protect customers and our business.

A payment authorization does not guarantee acceptance of an order.

11. SHIPPING AND DELIVERY

Perfume Wear currently ships to eligible addresses within the United States as described in our Shipping Policy.

Available shipping methods, charges, estimated handling times, and estimated delivery times are displayed on the Site, at checkout, or in our Shipping Policy.

We will make reasonable efforts to ship orders within the time represented to customers.

Delivery estimates are estimates and may be affected by carrier operations, weather, holidays, address problems, security checks, or events outside our reasonable control.

If we determine that an order cannot be shipped within the time promised, we will handle the delay, cancellation option, and any required refund in accordance with applicable law.

Customers are responsible for providing a complete and accurate delivery address.

Please review our separate Shipping Policy, which is incorporated into these Terms by reference.

12. RISK OF LOSS AND DELIVERY

Risk of loss transfers as provided by applicable law.

Customers should promptly report packages that arrive damaged, contain an incorrect product, or have another delivery-related problem.

Carrier tracking information may be considered when investigating a delivery claim, but it does not limit any rights available to the customer under applicable law.

13. RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, exchanges, eligibility periods, product-condition requirements, return-shipping responsibilities, and applicable exclusions are governed by our separate Refund Policy.

Our Refund Policy is incorporated into these Terms by reference.

If there is any conflict between the general language in these Terms and the specific return or refund provisions contained in the Refund Policy, the Refund Policy will control with respect to returns and refunds, except where applicable law requires otherwise.

Nothing in these Terms limits a customer's rights regarding merchandise that is materially different from what was ordered, merchandise damaged before or during delivery, unauthorized transactions, or other rights that cannot lawfully be waived.

Refunds approved by Perfume Wear are generally issued to the original payment method unless applicable law or the payment provider requires another method.

Processing time after a refund is issued may vary depending on the customer's financial institution.

14. ORDER CANCELLATION BY CUSTOMERS

If you wish to cancel an order, contact us as soon as possible.

We will make reasonable efforts to accommodate cancellation requests received before an order enters fulfillment or is shipped.

Once an order has entered fulfillment or has shipped, cancellation may no longer be possible, and the Refund Policy will apply.

Nothing in this provision affects cancellation or refund rights required by applicable law.

15. ORDER CANCELLATION BY PERFUME WEAR

We may cancel an order when reasonably necessary because of inventory problems, pricing errors, payment issues, suspected fraud, shipping restrictions, legal requirements, technical errors, or other legitimate business reasons.

If we cancel an order after collecting payment, we will provide the appropriate refund.

16. DISCOUNT CODES AND PROMOTIONS

Promotional codes and offers are subject to the conditions presented with the promotion.

Unless otherwise stated:

  • promotional codes may not be combined;

  • promotional codes have no cash value;

  • promotional offers may be limited by product, quantity, customer, or expiration date; and

  • we may correct or cancel a promotion affected by fraud, abuse, or obvious technical error.

Changes to a promotion will not affect orders already accepted except where necessary to correct fraud or an obvious error and permitted by law.

17. REVIEWS, FEEDBACK, AND USER CONTENT

If you voluntarily submit a review, photograph, suggestion, comment, or other content to us, you represent that you have the right to submit it and that it does not violate another person's rights.

You grant Perfume Wear a nonexclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and reasonably adapt content that you voluntarily submit for purposes connected with operating, improving, or promoting our business, subject to applicable law and our Privacy Policy.

We do not claim ownership of your underlying intellectual-property rights merely because you submit content to us.

18. WEBSITE CONTENT

Except for third-party material and trademarks, the Site's original content, layout, graphics, text, logos, photographs, software, and other materials owned or licensed by Perfume Wear are protected by applicable intellectual-property laws.

You may use the Site for personal, noncommercial shopping purposes.

You may not reproduce, distribute, sell, modify, or commercially exploit our proprietary Site content without prior authorization except as permitted by law.

19. THIRD-PARTY LINKS AND SERVICES

The Site may contain links to third-party websites, payment providers, social-media platforms, shipping providers, or other services.

We do not control third-party services and are not responsible for their independent content, policies, security practices, or availability.

A link to another website does not necessarily constitute an endorsement.

20. PRIVACY

Our collection and use of personal information are governed by our Privacy Policy.

Please review our Privacy Policy for information concerning the categories of information we collect, purposes for which information is used, disclosures, cookies, customer rights, and methods of contacting us concerning privacy matters.

21. ELECTRONIC COMMUNICATIONS

When you place an order, create an account, or communicate with us electronically, you consent to receive transactional communications electronically, including order confirmations, receipts, shipping notifications, account notices, and customer-service communications.

Marketing communications are subject to separate consent requirements and applicable law.

Electronic records and communications may satisfy legal requirements that communications be in writing to the extent permitted by law.

22. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

PRODUCT WARRANTIES, IF ANY, MAY BE PROVIDED BY THE APPLICABLE MANUFACTURER AND ARE SUBJECT TO THE MANUFACTURER'S TERMS.

NOTHING IN THESE TERMS EXCLUDES OR DISCLAIMS WARRANTIES, GUARANTEES, OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

23. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PERFUME WEAR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SITE.

THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.

NOTHING IN THESE TERMS IS INTENDED TO LIMIT LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR OTHER LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT US TO DISCLAIM.

YOUR RIGHTS UNDER APPLICABLE CONSUMER-PROTECTION LAW REMAIN UNAFFECTED.

24. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Perfume Wear harmless from claims, damages, liabilities, and reasonable expenses arising directly from your unlawful use of the Site, violation of these Terms, infringement of another person's rights, or fraudulent activity.

This provision does not require a consumer to indemnify Perfume Wear for Perfume Wear's own unlawful conduct, negligence where such liability cannot be waived, or other matters for which indemnification cannot legally be required.

25. FRAUD AND SECURITY

We reserve the right to investigate suspected fraud, unauthorized payments, chargeback abuse, account misuse, or other unlawful conduct.

We may cooperate with payment processors, financial institutions, shipping carriers, governmental authorities, or law-enforcement agencies when reasonably necessary and legally permitted.

Nothing in these Terms creates a representation that every instance of unlawful activity will be detected or prevented.

26. GOVERNING LAW

These Terms and transactions with Perfume Wear are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-laws principles, except to the extent another jurisdiction's mandatory consumer-protection laws apply and cannot lawfully be waived.

27. DISPUTES AND VENUE

We encourage customers to contact us first so that we can attempt to resolve concerns directly.

To the extent permitted by applicable law, legal proceedings arising from these Terms or a purchase from Perfume Wear may be brought in an appropriate state or federal court having jurisdiction in Harris County, Texas.

Nothing in this section eliminates any right to bring a matter in small claims court where permitted or any venue right that applicable law does not allow the parties to waive.

28. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in our business, Site, policies, or applicable law.

The updated Terms will be posted on this page with a revised “Last Updated” date.

Changes will apply prospectively except where applicable law permits otherwise.

Material changes will not retroactively alter an already completed transaction where doing so would violate applicable law.

29. SEVERABILITY

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

30. NO WAIVER

Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision later.

31. ENTIRE AGREEMENT

These Terms, together with the policies expressly incorporated into them, including our Privacy Policy, Refund Policy, and Shipping Policy, constitute the agreement governing use of the Site and purchases through the Site.

Product-specific terms disclosed before purchase may also apply.

If a specific product or promotional term conflicts with these general Terms, the more specific term will control for that transaction to the extent permitted by law.
